Working time

General statutory work regulations

As a general rule:

  • A working day may not last longer than 8 hours on average. It may be extended to 10 hours if the overtime is compensated for in a timely manner.
  • The rest period between two working days must be at least 11 hours.
  • Work on Sundays and public holidays is prohibited, except in exceptional cases permitted by law.

General working hours regulation at TOPdesk

  • Full-time employees (40 hours) generally work 8 hours per day (Monday – Friday), excluding break times. Employees can reduce their working hours at TOPdesk, after consultation with HR and the team leader – this also applies to temporary periods. In the case of part-time employment, the daily working hours are reduced accordingly and, if necessary, the working days change. How the working hours look in the case of part-time employment will also be agreed with the team leader and HR in the individual case.
  • Employees who work on-site at customers or are represented at trade fairs, etc. during a project must adjust their working hours accordingly. However, the daily working time may not exceed 10 hours.
  • There are no fixed core working hours.
  • Reasonable working hours result from the availability of customers or the presence of colleagues (e.g. daily stand-up at 08:00).
  • In support as well as in sales, availability must be guaranteed during official service hours. In this case, the team must reach an agreement.

  • If you work less than 5 days a week, you must determine which days are considered working days. In justified exceptional cases (e.g. to attend a training course) you can work on a “day off” after consultation with your team leader, but you should compensate the hours worked promptly on another day.

  • A legal exception for working on weekends, holidays or at night, which applies to TOPdesk, is work to maintain the functionality of data networks and computer systems. In this case, insurance coverage is provided by the BG.
  • On regional holidays during the week, field staff may be deployed in regions where the holiday does not apply. On such holidays, a contingency staff discussed in advance in the team may also work in order to be able to provide support services for customers. -> The working time performed on such a holiday may be recorded as overtime in addition to the holiday. Since this may generate a 10h+ day in LIFT, please write explanation in the “Notes” window.
  • Working in the evening or at night is possible, as long as it is not a Sunday or holiday. Afterwards, the rest periods must be observed in any case.

    Note: Working on Sundays and holidays and in the evening or at night must be discussed with your supervisor and HR in advance and requires approval.

  • Dinner, etc. does not count as working time and therefore must not be entered in LIFT.
  • Especially for colleagues who work part-time and are still working before the annual meeting, the presentation part may result in overtime, which may be taken into account.
  • If the sales evening falls on the last day of a payroll period (as of 09/19: 15th of a month), students should notify the HR team prior to the sales evening so that the hours can be considered accordingly for the current payroll.

 

Team Events:

  • While team events are generally recreational in nature, they are primarily organized for team building purposes, which is why the hours may be claimed for them.
  • For participation in team events, the average daily working time may be written down under “special leave / excursion“, regardless of whether the team event, including travel time, lasted longer or shorter.

 

Set-up and tear-down:

  • If you are involved in the set-up and dismantling of a company event (whether as a student or permanent employee), you may of course write down these hours as working time, just like hours you worked before the respective event.
  • Exception: Summerfest in Germany
    Although the summer party actually counts as an event of a purely recreational nature, the following applies: If the start of the summer festival overlaps with your otherwise normal working hours, you do not have to make minus hours. Fill up your hourly account with as much time as you need to reach your average daily working hours. As a general rule, you may not work overtime as a result of attending the summer party.

 

It does not count as working time:

  • Company events of a purely recreational nature: Attending company events of a purely recreational nature, such as the Christmas party or the summer party in NL, does not count as working time and accordingly may not be recorded in LIFT.
  • This applies to both permanent employees and students, and refers to events at TOPdesk DE as well as at any other branch abroad.
